Terms of Service & Legal Disclosures
Last updated: August 2026
Important: By using Fylit, you acknowledge that Fylit is software, not a tax preparer, CPA, or law firm. Read these terms before using the product.
Operating company
These terms and legal disclosures are provided by Vyrtox LLC, a Wyoming limited liability company. Fylit is the software and service offered at https://fylit.tax.
What Fylit Is
Fylit is a software product. It organizes information you provide into compliance-related drafts based on your inputs. Fylit is not a Certified Public Accountant (CPA), enrolled agent, tax attorney, or any kind of licensed professional. Using Fylit does not create a client-professional relationship of any kind.
Software Tool, Not a Tax Preparer
Fylit operates as a software tool under the principles described in IRS Circular 230 and 26 CFR § 301.7701-15. All output is generated automatically from your inputs. No Fylit employee or contractor reviews, edits, or approves your data, forms, or drafts for tax accuracy. You operate the software. You are responsible for the accuracy of your inputs and any filing decision you make.
Fylit builds compliance drafts from your inputs. IRS content here is informational only, not tax or legal advice. Reviewing drafts with a tax professional is recommended before filing.
No Tax Advice. No Legal Advice.
Nothing on this site, in the Fylit software, or in any output generated by Fylit constitutes tax advice, legal advice, or professional opinion about your specific situation. Profile-based guidance reflects general IRS instruction patterns, not a determination of your obligations. Always consult a licensed tax professional before making any filing decision.
As-Is Software, No Warranty
Fylit is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular tax purpose, accuracy, completeness, or currentness. IRS rules change. Fylit does not guarantee that its output is current, correct, or appropriate for your circumstances.
You Are Solely Responsible
You are solely responsible for: (1) the truth, accuracy, and completeness of all information you submit; (2) reviewing all software output before any filing; (3) any filing, payment, or communication with the IRS; (4) any penalties, interest, audits, or IRS actions arising from your filings or non-filings; and (5) your selection and engagement of any third-party professional, including any practitioner listed in Fylit's informational directory.
Limitation of Liability
To the maximum extent permitted by applicable law, Fylit and its officers, employees, and contractors are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits or damages arising from reliance on any software output. Separately, and whether characterized as direct or indirect, Fylit is not liable for any penalty, interest, addition to tax, or assessment imposed by any tax authority, including penalties under IRC section 6038A, nor for the cost of responding to any audit, notice, or examination. These limitations apply regardless of the theory of liability and even if Fylit has been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so your rights may vary.
To the maximum extent permitted by applicable law, the total aggregate liability of Fylit arising out of or relating to your use of the software, whether in contract, tort, statute, or otherwise, will not exceed the greater of the total fees you paid to Fylit in the twelve months before the event giving rise to the claim, or one hundred US dollars. This cap applies to all claims in aggregate, not to each claim separately.
Penalty Information
Penalty figures cited on this site and in the software are based on IRC §6038A(d) as of April 2026: $25,000 initial penalty per form per tax year, plus $25,000 per 30-day period after an IRS notice with no statutory cap. These figures reflect the increased amounts applicable to tax years beginning after December 31, 2017. Fylit makes reasonable efforts to keep cited figures current but cannot guarantee they reflect the most recent IRS guidance. Verify current penalty amounts with the IRS or a licensed tax professional.
No Filing. No Faxing. No IRS Representation.
Fylit does not file returns, submit forms, or fax documents to the IRS on your behalf. Fylit does not represent you before the IRS in any capacity. All generated drafts are yours to review, finalize, sign, and submit through the channel of your choice. Fylit is not a filing agent or power of attorney.
Expert Directory
Fylit may display an informational directory of independent tax professionals identified through public records. Fylit is not affiliated with any listed practitioner, has not verified their current licensing, and does not endorse, recommend, or guarantee their work. Use your own judgment when selecting a professional. The directory is for informational purposes only.
Data and Privacy
Fylit collects the information you choose to submit to generate compliance drafts. We do not sell your personal information. See the Privacy Policy at https://fylit.tax/privacy and Cookie Policy at https://fylit.tax/cookies. Contact [email protected] with privacy questions.
Refunds
Thirty days, no questions asked. If you are not happy with your packet for any reason, email us within 30 days of your purchase and we will refund you in full. You do not need to give a reason, and we will not ask for one. We also refund you without being asked if we cannot produce your packet at all: if we cannot generate your forms for the tax year you paid for, if your situation turns out to be one Fylit does not support, or if you were charged more than once. Refunds are issued to the original payment method. One thing this guarantee is not: a promise about your tax outcome. Fylit is software, you are the self-preparer and the signer, and we do not review your forms for accuracy or completeness. This guarantee covers your satisfaction with what we deliver to you, not how the IRS treats what you file.
Governing Law and Disputes
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. You and Vyrtox LLC agree to the exclusive jurisdiction of the state and federal courts located in Wyoming for any dispute arising out of these terms. Nothing in this section removes any mandatory right you have under the consumer protection law of your country of residence, including any right to bring proceedings in your local courts where that law gives you one.
Changes to These Terms
Fylit may update these disclosures as the product evolves or as legal requirements change. Material changes will be communicated to registered users. Continued use of Fylit after changes constitutes acceptance of the updated terms.
